BASIC STRUCTURE OF A BOND

First, the defendant is taken to a holding facility and the person is ‘booked in’. This booking process involves fingerprinting, mug-shot, and a search to find if any outstanding warrants exist. This process may take a several hours. Most defendants are eligible for bail and it is set by a Judge.

WHAT IS A FORFEITURE?

What Happens When a Forfeiture Occurs? The action of forfeiture is when a person does not make their court appearance. Although it can compromise the bail agreement and the court’s view of the defendant. So, if defendant fails to go to court, please inform us immediately. The defendant must be brought back to court immediately in order to protect the bail bond company and the co-signers.

WHEN AM I RELEASED FROM MY FINANCIAL RESPONSIBILITY?

This is also referred to as “exoneration” or “discharge” of the bail bond. The liability of a bail bond is removed once all of the terms have been satisfied, which includes attendance at all court proceedings. The defendant is still responsible for any fines or penalties associated with the case. Upon court verification of the discharge of the bail bond, the bail agent will typically return items that were pledged as collateral, unless outstanding premium or other payments are due.
